Terms of use
Effective September 9, 2026. Applies to tariffsolutions.ca and the tariff lookup tool on it.
Short version: the lookup tool is a convenience, not advice. It can be wrong, incomplete, or out of date, and you agree not to make import, pricing or customs decisions on it without confirming with your customs broker or the CBSA. If you use the site, you accept these terms.
1. Who these terms are between
These terms are an agreement between you and Browes AI, operating as Tariff Solutions (“Tariff Solutions”, “we”, “us”), a Canadian technology services business. By accessing tariffsolutions.ca (the “Site”) or using the product checker and sector lists on it (the “Lookup Tool”), you agree to these terms. If you do not agree, do not use the Site.
The Site is intended for businesses and the people acting for them. If you are using it as a consumer for personal, family or household purposes, some limitations below may not apply to you under consumer protection law; nothing in these terms is meant to remove rights that the law does not allow us to remove.
2. What the Lookup Tool is, and is not
The Lookup Tool searches a copy of the Department of Finance Canada list of goods subject to counter-tariffs effective September 8, 2026, as most recently reproduced by us. The list date is shown on the Site. The tool matches the words or HS code you type against the tariff items and indicative descriptions in that copy.
The Lookup Tool is not a tariff classification service, a ruling, a duty calculation, an origin determination, or legal, customs, tax or trade advice. Tariff Solutions is not a licensed customs broker, lawyer or accountant. Whether a specific good is subject to a surtax depends on its correct classification under the Customs Tariff, its country of origin under the applicable marking and origin rules, its value, any remission or exemption, and the state of the law on the day it is accounted for, none of which the Lookup Tool determines.
3. Errors, omissions and currency of information
You acknowledge and agree that:
(a) the data behind the Lookup Tool is a reproduction of a government list and may contain transcription errors, omissions, or formatting differences from the official source;
(b) the government may amend, add to, remove, suspend or repeal tariff measures at any time, and the Site may not reflect a change for some period after it is made, or at all;
(c) the search function uses keyword and synonym matching that can return tariff lines that do not apply to your product, and can fail to return lines that do;
(d) a result of “no match” does not mean a product is exempt, and a result showing a tariff line does not mean a product is subject to it;
(e) sector groupings, plain-language labels and example searches on the Site are our editorial additions and have no legal status; and
(f) the only authoritative sources are the Customs Tariff, the relevant Orders in Council and Customs Notices, and determinations of the Canada Border Services Agency.
4. No reliance; your responsibility
You agree that you use the Lookup Tool at your own risk and will not rely on it as the basis for any decision, including decisions about importing, pricing, sourcing, contracting, classification, origin, valuation, remission, or compliance. Before acting, you will verify any result against the official sources and with a licensed customs broker, trade lawyer or the CBSA. You are solely responsible for any duties, surtaxes, penalties, interest, seizures, delays, lost sales or other consequences of your import and business decisions, whether or not you consulted the Site.
5. No warranties
The Site and the Lookup Tool are provided “as is” and “as available”. To the maximum extent permitted by law, Tariff Solutions disclaims all representations, warranties and conditions of any kind, express, implied or statutory, including any warranty or condition of accuracy, completeness, currency, reliability, merchantability, fitness for a particular purpose, title, non-infringement, or uninterrupted or error-free operation. We do not warrant that the Site will be available at any time, that defects will be corrected, or that the Site is free of viruses or other harmful components.
6. Limitation of liability
To the maximum extent permitted by applicable law, Browes AI, Tariff Solutions, and their owners, directors, officers, employees, contractors, agents, suppliers and licensors (together, the “Released Parties”) will not be liable to you or to anyone claiming through you for any loss or damage of any kind arising out of or connected with the Site or the Lookup Tool, or your use of or inability to use them, or any error, omission, inaccuracy or delay in the information on them, including without limitation direct, indirect, incidental, special, consequential, exemplary or punitive damages; loss of profits, revenue, savings, business, goodwill or data; duties, surtaxes, taxes, penalties, fines or interest assessed by any authority; costs of substitute goods or services; or claims by third parties. This exclusion applies whether the claim is in contract, tort (including negligence), misrepresentation, breach of statutory duty, or otherwise, and even if a Released Party was advised of the possibility of the loss.
If, despite the paragraph above, a Released Party is found liable to you for any matter arising out of the Site or the Lookup Tool, the total aggregate liability of all Released Parties will not exceed one hundred Canadian dollars (CAD $100).
Nothing in these terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot be excluded or limited under the laws that apply to you. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of Sections 5 and 6 may not apply to you.
7. Indemnity
If you use the Site in the course of a business, you agree to indemnify and hold harmless the Released Parties from any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of your use of the Site or the Lookup Tool, your reliance on any information on them, your breach of these terms, or your violation of any law or third-party right.
8. Services are separate
These terms govern the free, public Site and Lookup Tool only. Any sourcing diagnostic or other paid service is governed by a separate written agreement, and nothing on the Site is an offer to provide such services to you until that agreement is signed. Submitting a form on the Site does not create a client relationship.
9. Acceptable use
You may use the Site for lawful business research. You may not scrape, harvest or bulk-download the Site or its data by automated means other than ordinary search-engine indexing; reproduce or redistribute the Lookup Tool or our sector groupings as your own product; use the Site to build a competing tariff lookup service; interfere with the Site's operation or security; or submit false, misleading or malicious content through our forms. We may block access to anyone who breaches these terms.
10. Intellectual property and third-party content
The tariff list is Government of Canada information reproduced for convenience, and remains subject to its own terms. Everything else on the Site, including the design, code, text, synonym mappings and sector groupings, is owned by Browes AI or its licensors and is protected by copyright and other laws. You may view and print pages for your own business use with this notice intact. Links to third-party sites are provided for convenience; we are not responsible for their content.
11. Privacy
Our privacy policy explains what information we collect through the Site and how we use it, and forms part of these terms.
12. Changes and termination
We may change these terms, the Site or the Lookup Tool, or stop offering any of them, at any time without notice. Changes to these terms take effect when posted; the effective date at the top will change. Your continued use after a change means you accept it. Sections 3 through 8, 10 and 13 survive any termination of your access.
13. Governing law and disputes
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree that the courts of British Columbia have exclusive jurisdiction over any dispute arising out of the Site or these terms, and you waive any objection to that venue, except that either party may seek injunctive relief in any court of competent jurisdiction. Any claim must be brought within one year after it arises, or it is barred to the extent the law allows.
14. General
If any part of these terms is held unenforceable, the rest remains in effect and the unenforceable part will be enforced to the maximum extent permitted. Our failure to enforce a term is not a waiver. These terms are the entire agreement between you and us about the Site. You may not assign your rights under them; we may assign ours to a successor of the business. Questions about these terms: hello@tariffsolutions.ca.
This document is written to be effective under the laws of British Columbia and Canada. It is not legal advice to you, and Tariff Solutions recommends that anyone relying on tariff information obtain their own professional advice.
